The Silence We Often Ignore

What should happen to a child being the safest in the outside world when it could be the very place he or she knows?

Research and reports have continuously indicated that in most instances the abuser is a person the child is familiar with and trusts. However, these experiences are usually covered by fear, confusion and social stigma. This is precisely what the laws such as the POCSO Act are designed to break.

Understanding the Law

The POCSO Act (2012) is a broad legislation targeting to safeguard victims less than 18 years of age against sexual crimes. It addresses sexual assault, sexual harassment, and children exploitation in pornography. It is also aware of aggravated offences, in which an abuse is perpetrated by an individual in a status of trust, like a teacher, relative, or caregiver. Notably, the legislation is gender-neutral as every child is offered protection.

Why POCSO is Unique?

The key feature of this law is child-centered, as it is not only concerned with punishment but also with emotional safety and dignity of the child.

  • Special courts: More expeditious and sensitive trials.
  • Mandatory reporting: Legal requirement to report abuse.

    As more people use the internet, the threats have now gone beyond the physical premises. Online threats to children include grooming and cyber exploitation. The POCSO Act has addressed these contemporary issues, and it is therefore very applicable in contemporary setting.

    Though the law has good provisions, not all cases are reported, as people do not want to be stigmatized. This renders awareness important. Teachers, parents, and professionals should:
